Data protection

The protection of your personal data is particularly important to us. We therefore process your personal data (“data” for short) exclusively on the basis of the statutory provisions. With the data protection declaration we want to inform you comprehensively about the processing of your data in our company and the data protection claims and rights to which you are entitled.

What is data protection?

In general, data protection means protecting personal data from improper data processing . Often in connection with the protection of privacy.

If you contact us using the form on the website or by e-mail, the data you provide will be stored by us for six months in order to process the request and in the event of follow-up questions. We do not pass on this data without your consent.

The following data is also stored by us in the course of business transactions.

As a customer in our online shop: first and last name, address, contact details (e-mail address, telephone number.

As a corporate customer: company name, address, commercial register number, VAT number, e-telephone number (mobile phone number), email address, fax

The data you provide are required to fulfill the contract or to carry out pre-contractual measures. Without this data, we cannot conclude the contract with you. There is no data transfer to third parties, with the exception of the transfer of the credit card data to the processing bank / payment service provider for the purpose of debiting the purchase price, to the transport company / shipping company commissioned by us to deliver the goods and to our tax advisor to fulfill our tax obligations.

For what purposes and on what legal basis is the data processed?

We process your data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act in the currently applicable version: • To fulfill (pre-) contractual obligations (Art 6 Para. 1 lit.b GDPR): Your data is processed for the sale and distribution of our goods and services, for procurement and logistics purposes as well as for customer management and analysis. The data is processed in particular when initiating business and when executing contracts with you. • To fulfill legal obligations (Art 6 Paragraph 1lit.c GDPR): Your data is processed for the purpose of fulfilling various legal obligations, e.g. from the Company Code (UGB) or the Federal Tax Code (BAO), money laundering regulations, product-specific regulations such as the Raw Materials Regulation , Chemical legislation required. • To safeguard legitimate interests (Art 6 (1) (f) GDPR): On the basis of a balancing of interests, data processing can take place beyond the actual fulfillment of the contract to safeguard our legitimate interests or those of third parties. In any case, in the following cases, data is processed to safeguard legitimate interests:

  • Consultation of and data exchange with credit agencies and creditor protection associations for the determination of creditworthiness data;

  • Advertising or marketing

  • Measures for business management and further development of services and products;

  • Measures to protect our company from behavior contrary to the contract or the law, e.g. access controls, video surveillance;

  • in the context of legal prosecution.

If you have given us your consent to process your data, processing will only take place in accordance with the purposes specified in the declaration of consent and to the extent agreed therein. A given consent can be revoked at any time with effect for the future, e.g. to send our newsletter or to transfer data to third parties. This will allow the lawful processing of your data

How long will your data be stored?

We process your data until the end of the business relationship or until the expiry of the applicable guarantee, warranty, statute of limitations and statutory retention periods (e.g. from the Corporate Code (UGB), the Federal Tax Code (BAO)); in addition, until the end of any legal disputes in which the data is required as evidence.

We would like to point out that, for the purpose of simplifying the shopping process and for later contract processing, the web shop operator stores the IP data of the subscriber as part of cookies, as well as the name, address and credit card number of the buyer.

After canceling the shopping process, the data stored by us will be deleted.

In the event of a contract being concluded, all data from the contractual relationship will be stored until the expiry of the tax retention period (7 years).

The data name, address, purchased goods and date of purchase are also stored until the end of product liability (10 years). The data processing takes place on the basis of the legal provisions of § 96 Abs 3 TKG as well as Art 6 Abs 1 lit a (consent) and / or lit b (necessary to fulfill the contract) of the GDPR.

What are cookies and how do we use them?

Our website uses so-called cookies. These are small text files that are stored on your device with the help of the browser. They do no harm.

What are your rights?

In principle, you have the right to information, correction, deletion, restriction, data portability, revocation and objection. If you believe that the processing of your data violates data protection law or your data protection claims have been violated in any other way, you can complain to the supervisory authority. In Austria this is the data protection authority.
